Divorce

   

     A simple uncontested divorce can often be accomplished without either party having to attend court.  The requirements under North Carolina law for a simple divorce are:

1.  At least one of the parties has lived in North Carolina for a least six
months.
2.  The parties have been separated for a least one year with one or both parties intending to end the marriage. 
3.  The parties are legally married.


    Other possibilities include annulment, divorce from bed and board, and divorce based on incurable insanity.  One should always consult an attorney before filing for divorce or ignoring a divorce complaint.  A divorce can end your right to sue for equitable distribution (property division) and/or spousal support (post-separation support and alimony).
