If you owe more in credit cards than you even make in a year then Chapter 7 bankruptcy may be the best remedy to escape the debt cycle of minimum monthly payments. Although there are many myths about bankruptcy the truth is most people who file don't lose any property. The typical Chapter 7 bankruptcy lasts from 4-6 months in total. The end result is the debtor is free of most unsecured debt such as credit cards, repossessions, judgments, and payday loans. With those debts gone, any remaining debt such as child support, alimony  student loans, and secured debts are suddenly more affordable.
Chapter 13 is often the last resort for a homeowner facing foreclosure who wants to save their home. It is important to realize that Chapter 13 will not lower a first mortgage payment. The only way to lower a first mortgage payment is usually a loan modification directly from the bank. Sometime a Chapter 13 can eliminate a second mortgage payment depending on the  amount of equity in the home. Filing a bankruptcy yourself is not for the faint of heart, but is certainly your right. There are even filing fee waivers available for those below certain income thresholds, but be aware your first payment is usually due within 30 days of filing and failure to make timely payment can result in immediate dismissal of your case. As many bankruptcy attorneys offer a free consultation it is certainly advisable to at least discuss your options with a licensed professional.
