How to file Bankruptcy in Charlotte NC
Chapter 7The proper venue to file bankruptcy in Charlotte is in Western District of North Carolina. The Charlotte division includes Mecklenburg, Union, Gaston, and Anson County. Ideally an attorney would help you prepare your petition and file your case electronically. If you file yourself you can file in person at the Federal Courthouse in uptown Charlotte.
Once your case is filed one of about 6 rotating trustees will be assigned to review your case. Most trustees will require that you send a copy of various paperwork (bank statements, tax returns, drivers license, social security card) before your creditor meeting which is held on a Wednesday about 30 days after you file. At the meeting you will be asked about your assets and debts. |
Chapter 13
A Chapter 13 usually involves monthly payments for 3-5 years, which is very different than the typical Chapter 7 that requires no payments. There is only standing Chapter 13 trustee in Charlotte- Warren Tadlock. A Chapter 13 petition is basically the same as Chapter 13 with the additional requirement of a Chapter 13 Plan Summary which details how much your monthly payment will be along with treatment of secured and unsecured creditors inside the plan. Upon filing a Chapter 13 you will be requested to send in certain paperwork similar that requested in Chapter 7 such as: Tax Returns, Driver's license, Social Security Card. The trustee may also want to examine your pay-stubs and bank statements. An additional requirement is a certification as to whether you have filed all your tax returns, or whether you owe any domestic support obligations such as alimony or child support. There will also be a creditor meeting at the Chapter 13 office near SouthPark mall in Charlotte. It will be expected that you have already made your first payment before this meeting.
